FAY, Circuit Judge:. The State of Florida appeals the grant of James Agan’s petition for writ of habeas corpus. We hold that the District Court for the Middle District of Florida properly issued the writ. Accordingly, we AFFIRM.

I. PROCEDURAL HISTORY
