LESLIE, Justice.

J. M. Cate, formerly an employee of the Ockland and the Orfic Gasoline Production Companies, corporations, filed this suit against those companies to recover damages alleged to have accrued to him by reason of the failure of the defendants “to employ a sufficient number of men at all times, and in each emergency, to enable the work to be performed with reasonable safety to the plaintiff, and to employ one or more men to substitute for the plaintiff at reasonable intervals of eight or ten hours.” That “notwithstanding said duty,” and although the principal cold spell of the…
