The nature and result of this case are clearly and fully stated by the Court of Civil Appeals. See (Tex. Civ. App.) 283 S. W. 1104. That court affirmed the judgment of the trial court. Briefly, this was a personal injury suit filed by Smith, a sawyer, against the West Lumber Company, eligible to subscribe to the Workmen’s Compensation Act (Vernon’s Ann. Civ.
