In an action to foreclose a mortgage, the defendant Aryeh Zaks appeals from a judgment of foreclosure and sale of the Supreme Court, Rockland County (Garvey, J.), dated April 14, 2014, which, upon an order of the same court dated July 27, 2009, inter alia, granting that branch of the plaintiff’s motion which was for summary judgment on the complaint and to appoint a referee, among other things, directed the sale of the subject premises.
