Appeal from a judgment of the County Court of Albany County (Turner, Jr., J.), rendered March 2, 1987, upon a verdict convicting defendant of the crimes of burglary in the first degree and attempted robbery in the second degree.

A police officer, who was responding to a radio transmission concerning a man peering into windows at 496 Madison Avenue in the City of Albany, observed defendant hurriedly exit from the rear door of that building.
