HENRY, Circuit Judge.

In this 42 U.S.C. § 1983 action, Sum-mum, a church, alleges that the City of Ogden (sometimes, “the City”), and various officials of the City, violated the church’s First Amendment rights. Both parties moved for summary judgment; the district court granted summary judgment in favor of the City of Ogden. Exercising jurisdiction pursuant to 28 U.S.C. § 1291, we affirm in part, reverse in part, and remand for further proceedings consistent with this opinion.
