Background
This case is before this Court on Defendant Ron Carey’s (“Carey”) motion for a declaration from this Court that it intends to grant Carey’s motion for relief from judgment under Fed.R.Civ.P. 60(b)(2), at such time as this case is remanded to it by the United States Court of Appeals for the Second Circuit. Carey seeks to move this Court for relief from the judgment entered on December 30, 1997, affirming the Election Officer’s disqualification of Carey from the International Brotherhood of Teamsters (“IBT”) rerun election.
