Plaintiff obtained a verdict of $25,083 for injuries sustained in an automobile accident which occurred shortly after 5 p. m. December 18, 1953, on Minnesota State Highway No. 7 a short distance west of Carver County Road No. 6.

This is an appeal from an order denying defendant’s motion for judgment notwithstanding the verdict or for a new trial. Defendant contends (1) that plaintiff was guilty of contributory negligence as a matter of law; (2) that defendant was free from negligence; (3) that the court erred in allowing plaintiff to answer the question, “when you saw…
