HIGGINS, Justice.

Frank B. Treat instituted this action to be declared the owner of an undivided one-e'ighth interest in and to the oil, gas, and •other minerals underlying the land described as the S% of the SE%, Section 18, Township 21 N., Range 9 West, in Webster Parish, Louisiana, under a deed from Sidney Turner to him, dated April 30, 1938, •and for an accounting of the proportionate part of the royalties accruing -to him.
