This matter is. before the court on the Defendants’ motion to dismiss the Plaintiffs’ complaint. In their complaint, Plaintiffs Upstate Forever and Savannah River-keeper allege that Defendants Kinder Morgan Energy Partners, L.P. (“Kinder Morgan”) and Plantation Pipe Line Company, Inc.
