Before the court is the Magistrate’s report and recommended decision, plaintiff Janet Palmer’s objections and defendant’s response thereto. The Magistrate concluded that summary judgment should be granted to defendant Secretary of Health and Human Services (the “Secretary”) on the ground that substantial evidence supports the Administrative Law Judge’s (the “AU”) determination that Palmer is not eligible for disability insurance benefits under the Social Security Act (the “Act”). 42 U.S.C. §§ 416(i), 423 (1988).
