Pending before the Court is the appellant’s appeal of a September 9, 2008, Board of Veterans’ Appeals (Board) decision that denied his claim for entitlement to compensation under 38 U.S.C. § 1151 for injuries resulting from a door malfunction at a VA hospital. On May 18, 2009, during the pendency of this appeal, but before briefing had begun, the appellant died. The merits of this case are not currently before the panel. The issue we address is whether 38 U.S.C. § 5121A, recently enacted in 2008, applies to this appeal or otherwise forms a basis for allowing the substitution of the…
