To comply with regulations promulgated by the Federal Transit Administration (“FTA”), defendant, New Jersey Transit Corporation (“NJ Transit” or “Agency”), adopted a drug and alcohol testing policy that includes random testing of employees responsi ble for safety-sensitive functions.
