MEMORANDUM OPINION

Presently before the Court is Respondent’s [9] Motion to Dismiss the Petition, which seeks dismissal of Respondent’s [1] Petition to Quash. Because Respondent’s [9] Motion relied on materials outside of the pleadings, the Court converted it to a motion for summary judgment pursuant to Federal Rule of Civil Procedure 56, as provided for by Federal Rule of Civil Procedure 12(d).
