In an action to recover damages for personal injuries, the defendant City of New York appeals from so much of an order of the Supreme Court, Kings County (Morton, J.), dated October 31, 1985, as denied its motion pursuant to CPLR 3211 (a) (7) to dismiss the complaint as against it, or, in the alternative, for summary judgment in its favor.

Ordered, that the order is affirmed insofar as appealed from, without costs or disbursements.
