Wilson Yother was convicted before a jury for murder in the second degree, and his punishment fixed at seven years in the State Penitentiary. .The case is here on appeal.
The first assignment of error is that the court erred in permitting Beatrice Evans to testify in the case.
Wilson Yother was charged with having killed Joe Holmes by cutting him with -a knife, one night in May, 1924. The case was tried on the 23rd of October, 1924.
