(dissenting) — I do not agree with the interpretation of Rem. Rev. Stat., §4706 [P.P.C. § 862-1], in the majority opinion, which, in effect, overturns the jury verdict and the judgment for plaintiff in the trial court.

The pertinent facts as to how six-year-old Donald Snow-den (hereinafter referred to as respondent) was injured are stated in the first several paragraphs of the majority opinion. However, a brief recap here may be helpful.
