—Order unanimously modified on the law and as modified affirmed without costs and matter remitted to Supreme Court for further proceedings in accordance with the following Memorandum: Plaintiff acquired certain mobile communications equipment as lessee under a self-described “finance lease.” The lease, assigned to defendant Unistar Leasing (Unistar) shortly after its inception, provides for a term of 12 months and for a “down payment” of $2,084.62 and 11 additional monthly payments of $525.21 plus tax.
