Michele Cianci sued M. Till, Inc. d/b/a Cherokee Country Club (Till) under the Dram Shop Act 1 for injuries she received when Michael Dee Bonin drove while intoxicated and collided with her car. Bonin patronized Till’s bar, the Cherokee Country Club, on the night in question. Till moved for a traditional summary judgment, contending that it had established the “safe harbor” defense as a matter of law. 2 Till also moved for a “no evidence” summary judgment on the ground that there was no evidence that it had violated the Dram Shop Act.
