Appeal from a judgment of the County Court of St. Lawrence County (Richards, J.), rendered October 21, 2013, convicting defendant upon his plea of guilty of the crime of rape in the third degree.
In satisfaction of a three-count indictment, defendant pleaded guilty to rape in the third degree and waived his right to appeal. Pursuant to the terms of the plea agreement, County Court placed defendant on interim probation for one year and promised to impose a sentence of probation if he successfully completed a substance abuse treatment program.
