Charles Demolli was tried arid convicted under section 3893 of the Revised Statutes [U. S. Comp. St. 1901, p. 2658] on an indictment charging him with having knowingly deposited and caused to be deposited in the post office at Trinidad, Colorado, for mailing and delivery, a newspaper called “II Eavoratore Italiano” and containing certain obscene, lewd, and lascivious articles.
