*1547Appeal from a judgment of the Oswego County Court (Walter W. Hafner, Jr., J.), rendered November 29, 2011. The judgment convicted defendant, upon a jury verdict, of criminal possession of marihuana in the second degree, criminal possession of marihuana in the fourth degree and growing of the plant known as cannabis by unlicénsed persons.

It is hereby ordered that the judgment so appealed from is unanimously modified as a matter of discretion in the interest of justice by reducing the sentence of incarceration imposed for criminal possession of marihuana in the second degree to a determinate…
