MEMORANDUM OPINION AND ORDER

WINGATE, District Judge.

Before the court is the motion of the defendant AIG Life Insurance Company for summary judgment pursuant to Rule 56(b), 1 Federal Rules of Civil Procedure, asking the court to dismiss plaintiff’s lawsuit in its entirety. Plaintiff Julie Woods Davis filed this action after the defendant refused to pay beneficiary proceeds to her from her deceased husband’s Blanket Travel Accident Insurance Plan (“The Plan”) which covered injuries sustained on business trips.
