PUDLOWSKI, Judge.

This is an appeal from a judgment entered by the Circuit Court, City of St. Louis for the respondent, Ruth Garcia, and against the appellant, James W. Bell, Exec utor of the Estate of Richard J. Bell. The judgment was entered pursuant to respondent’s motion for a summary judgment, which was sustained by the trial court. The facts are as follows.

Richard J. Bell was an employee of the City of St. Louis from 1971 until his death, September 3, 1979. As a city employee, there were a number of insurance and benefits programs available to the decedent. When decedent began work in…
