(after stating the facts). Upon the findings of law, and each of them, plaintiff assigned error. No error is assigned upon the findings of fact, nor upon a failure to find other or further facts. It does appear in the record, and we understand the fact is not disputed, that the statutory notice served upon plaintiff April 6, 1910, did not contain the statement that the sum demanded might be paid to the register in chancery, nor was it properly addressed.
