EVANS, Justice.

This is an appeal from a take nothing judgment entered in a non-jury trial against Thirty-Seven Hundred Corp., Inc. on its cross-action seeking indemnification against third party defendant, Boyce Fuller.

This suit was brought by Earline Dugas, Individually and as Independent Executrix of the Estate of John Allen Dugas and Robert H. Zoda, Jr. as Administrator with Will Annexed of the Estate of John Allen Dugas, against Fred M.
