Harvey, J.:

The appellant, T. B. Boyd, was state treasurer. He and Ronald Finney were jointly charged in two counts with the violation of R. S. 75-2415. Upon his separate trial he was found guilty and sentenced, as that statute provides, and he has appealed.

The state treasurer, in addition to other duties imposed by law, is the fiscal agent of the state. All bonds issued by the state, or any county, township, school district, or municipality of the state, are payable at his office, and he is liable on his official bond for all funds coming into his…
