This is an appeal 'by the Western Surety Company, intervener, from a judgment in favor of the Miner Town*587ship school district, one of the defendants. The other defendants constitute the school district board. No judgment was rendered for or against them and they need not be further mentioned. We refer to respondent in the singular, meaning the school district.
