The petition of William C. Ellern prays that the judgment of the superior court of Washington for Spokane county entered March 20, 1944, adjudging him to be an insane person and directing his confinement in a hospital at American Lake, be vacated. The prosecuting attorney for Spokane county appeared by a demurrer to the petition. The grounds of the demurrer were that the petition did not state facts sufficient to constitute a cause of action, and that the action had not been commenced within the time limited by law.
