At the January term, 1918, of the superior court of Floyd county, M. E. Scoggins was convicted of voluntary manslaughter. A motion for new trial was overruled, and on February 1, 1919, the judgment was affirmed by this court. See Scoggins v. State, 23 Ga. App. 366 (98 S. E. 240). No sentence was pronounced against the defendant during the term at which he was convicted. On April 14, 1919, during a regular term of the court, the judge had the defendant brought before him, and when the defendant was asked if he had anything to say why sentence should not be passed upon him, he filed objections,…
