Affirming.
The Boyd county grand jury, at the January term, 1934, of the Boyd circuit court, returned an indictment in which Vivian Nickolls, Marie Dunn, and appellant Ed Murphy were jointly charged with the crime of unlawfully, maliciously, and feloniously assaulting W. H. Mirandi with an offensive weapon, with the felonious intent to rob him of money and property of value, an offense denounced by section 1160, Kentucky Statutes.. On trial of the case, at the same term, the jury returned a verdict of guilty and fixed Ms punishment at five years’…
