HENDERSON, Judge.
Appellant was convicted of murder in the second degree, and his punishment fixed at six years confinement in the penitentiary. This case came before us on a former appeal and was reversed. See 8 Texas Ct. Rep., 141. The facts are fully stated in that opinion, and those presented in this record are substantially the. same, and we accordingly refer to that opinion for the facts.
