The plaintiff married the widow Atkins, whose children by her /former marriage are the defendants in this suit. Shortly after the death of hi£ r^vife, ho instituted proceedings iu the Court of Probates Tor the purposes: 1st, *230Of withdrawing from the succession his separate property and right's. 2d.
