Petitioners1 request that we set aside a policy statement issued by the Interstate Commerce Commission (ICC or Commission) in a proceeding formally entitled Ex Parte No. MC-122 (Sub-No. 2), Lease of Equipment and Drivers to Private Carriers (February 9,1982). In essence, the ICC has announced a new formula for determining whether a particular transportation leasing arrangement constitutes “for-hire carriage,” subject to ICC regulation, or “private carriage” exempt from such regulation.
