This is an appeal from the district court of Muskogee county, wherein the plaintiff in error, hereinafter referred to as defendant, was convicted of the crime of manslaughter in the first degree in the killing of Ike Vance, and his punishment fixed by the jury at imprisonment in the state penitentiary for a period of seven years.

Defendant was charged jointly with Willie Rainey with having on the 14th day of December, 1932, shot and killed Vance.
