AEMSTEONG, Judge.
The indictment in this case charges the appellant, Mose Offitt,- with the murder of Bud Ivey, in Mc-Alester, Pittsburg county, Okla., on the 3d day of November, 1908.
The evidence discloses the fact that the appellant and the deceased were both working as waiters, at the Busby Hotel in McAlester during November, 1908. The proof shows that the shooting occurred about 8 o’clock in the evening, and that death, caused by the wound, occurred about 1:30 the following morning.
