Plaintiff brought this action against the defendant, a practicing physician and surgeon, and alleged that the defendant was negligent in treating an injury plaintiff had sustained. D'efendant pleaded the statute of limitations, section 2300, Rev. Code 1919, as amended by chapter 71, Laws 1927. The statute is as follows: "An action against a physician, surgeon, dentist, hospital or sanitarium for malpractice, error, mistake or failure to cure, whether based on contract or tort,” must be brought within two years.
