CUSHMAN, District Judge.

The United States attorney demurs to the petition for habeas corpus. By the petition it appears that the petitioner, a young man born in Greece, came to America in 1908, coming direct to Oregon, where he worked at common labor and as a cook. He has been employed in lumber camps and on section gangs. He was a private in the late war. Petitioner has been held to answer to the grand jury by the United States commissioner. The grounds for discharge are that there is no proper cause for holding the petitioner to answer, and that the bail is excessive; that the only showing…
