Southeastern Pennsylvania Transportation Authority (SEPTA) appeals an order of the Philadelphia County Court of Common Pleas (trial court) which overruled SEPTA’s preliminary objections to the petition filed by the appellee herein, Frankford 5206 Bar, Inc. (the Bar), for appointment of a board of view to assess damages resulting from an alleged de facto taking and displacement pursuant to the Eminent Domain Code (Code), Act of June 22, 1964, Special Sess., P.L. 84, as amended, 26 P.S. §§ 1-101 to 1-903.
