Appeal from a judgment of the Supreme Court (Teresi, J.), rendered September 25, 2002 in Albany County, upon a verdict convicting defendant of the crime of criminal possession of a controlled substance in the third degree.

Police conducted a narcotics investigation targeting Anthony Buchanan. On the day in question, a detective saw Buchanan emerge from a building and hand defendant a plastic bag containing a substance believed to be crack cocaine, which defendant placed in the rear of his waistband.
