OPINION Riner, Justice.

The District Court of Sheridan County rendered the judgment in question here, in an action where Pete Tissino, James Evangeline and Ludine Z. Evangeline were the plaintiffs and Harry Mavrakis was defendant. Hereinafter for convenience, all parties to the action will be designated as they appeared in the District Court or by their surnames. The judgment aforesaid found in favor of plaintiffs and was so rendered.
