THE COURT.

The appellants were jointly indicted with one Lyle Eoss by the grand jury of Shasta County in two counts for the crimes of conspiracy to commit grand theft and conspiracy to commit robbery. The charge of grand theft consisted of the stealing of an account book, checks and cash in excess of the sum of $200, belonging to International Hod Carriers and General Laborers Union of America, Local 961. Lyle Eoss pleaded guilty to both counts of the indictment and became a witness at the trial against the appellants. The appellants were convicted of conspiracy to commit grand theft. They…
