Prior to October, 1940, the petitioner was an assistant court clerk in the Municipal Court of the City of New York. He was also a member of the New York National Guard. Between October 15, 1940 and October 31, 1941, he was in the active military service in the National Guard, and, on termination of that service, he returned to the Municipal Court, as deputy clerk of court. On January 24, 1942, he returned to active military service in the National Guard, as a sergeant, and, on August 1, 1942, he became a first lieutenant in the United States Army Reserve, on active duty.
