Appeal by the defendant, Luigi Lagroppo, from a judgment of the Court of General Sessions- of the Peace in and for the city and county of New York in favor, of the plaintiff, entered on the 20th day of February, 1903, convicting the defendant of murder in the second degree and sentencing him to imprisonment for life.

It is claimed on behalf of the People that on the 30th day of May, 1902, at about half-past five o’clock in the afternoon Antonio *221Avocato came to his death from wounds inflicted upon his person by the defendant. While there is considerable contradiction in the testimony, yet upon all of the essential features of the case there is little conflict.
