This was an action in assumpsit brought by appellee against appellant in the Circuit Court of. Fayette county. The declaration contains two special counts, in substance the same, based upon an agreement made by appellant for the sale of growing timber upon 160 acres of land. The common counts for goods sold and delivered, money lent, and account stated, are added. A general demurrer to the declaration was overruled and defendant (appellant) filed the general issue and six special pleas. A general demurrer to the special pleas was sustained.
