MEMORANDUM ORDER
EUGENE A. GORDON, Chief Judge.
This matter came on for hearing before the Honorable Edwin M. Stanley, late Chief Judge for the Middle District of North Carolina, on the defendant’s motion for summary judgment under Rule 56 of the Federal Rules of Civil Procedure. Judge Stanley heard the oral arguments of the parties on December 2, 1971, but his untimely death occurred before he issued a ruling on the motion. The attorneys for both sides have stipulated that the Court can rule on the pending motion for summary judgment from the record and the transcript of the oral arguments…
