The Connecticut Light and Power Company, petitioner, under the provisions of its charter, brought this petition to a judge of the Superior Court for the appointment of a committee to assess damages for the taking of certain tracts of land which would be flooded as a result of the construction of its dam near Zoar Bridge on the Housatonic River.
One of the pieces of land referred to in the petition, belonged to the respondent McCarthy, appellant, and is described as a lot fronting on the River Road in the town of Oxford, forty-five feet, and extending back from the road one hundred feet, being…
