For reasons satisfactory to the court, the judgment, to be entered in this case, was not finally agreed upon until the close of our last regular session in the eastern district.
While the questions raised in the court below and here are quite numerous, the case clearly hinges upon a few undisputed *178facts and controlling questions of law which have been argued \yith great zeal and ability by the learned counsel for the respective parties. These are entitled to special notice; but all subordinate questions become immaterial, and no useful purpose would be subserved…
