Appeal by the defendant, The Harvey Steel Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 16th day of November, 1895, upon the verdict of a jury rendered after a trial at the Kings County Circuit, and also from an order entered in said clerk’s office on the 18th day of November, 1895, denying the defendant’s motion for a new trial made upon the minutes.

Pratt, J.:

This is an appeal from a judgment in favor of the plaintiff entered upon a verdict of a jury and from an order denying defendant’s motion for a new trial.

The complaint alleges the incorporation of the defendant in the State of New Jersey in 1886, and that prior to October 1, 1890, the plaintiff, at the request of the defendant, rendered work, labor and services and paid out money for its benefit to the amount of $10,000, which defendant has failed to pay.
