Action for a libel; brought to the Superior Court in Hartford County, and tried to the jury before Torrance, J. Verdict for the plaintiff, and appeal by the defendant for error in the charge of the court. The case is fully stated in the opinion. 1. Under the statute (Gen. Statutes, § 1116) it was necessary for the plaintiff to prove “ malice in fact.” The statute provides that the defendant may “prove his intention.”
